Debates of the Constituent Assembly of India: Constitutional Ideals and the Foundation of Democratic State Formation Subir Gayen, Assistant Professor, Dhrubachand Haldar College, Dakshin Barasat, West Bengal, India
The Constituent Assembly Debates of India are one of the most important intellectual and democratic exercises in the constitutional history of the country. They provide a full account of the conversations, arguments and arrangements that led to the formation of the Constitution of India during 1946-49. The paper deals with the Constituent Assembly Debates as the foundation of the constitutional ideals and democratic state-building of India. It looks into the major issues like fundamental rights, federalism, secularism, social justice, protection of minorities, parliamentary democracy and Directive Principles of State Policy and how the framers dealt with them. The study, through an analysis of the debates, points to the philosophical vision, political compromises and institutional choices that continue to influence India’s constitutional governance. The paper also examines the present-day relevance of these debates, both for the interpretation of constitutional provisions and in the light of new legal and political challenges.
